Terms & Conditions

1. DISPLAY

i. The client(s) grants permission for the photographer to display any photograph covered by this contract for promotional purposes, including but not limited to advertising, brochures, magazine articles, websites, and sample albums, unless otherwise specified.

2. CREATIVE LICENSE, COVERAGE, AND REPRODUCTION

i. Photographs taken during the shoot are at the photographer's discretion, with efforts made to meet client requirements. ii. Due to lighting conditions and digital sensor limitations, colors may vary in the photographs. iii. The photographer is not liable for technical failures resulting in non-produced photographs, despite regular equipment checks and backup availability.

3. PAYMENT

i. Clients can cancel photoshoot bookings up to 24 hours before the shoot, with no refund after this period. ii. The deposit is non-refundable but can be used to book another session. iii. Additional services must be paid in full at the time of ordering. iv. Ownership of goods remains with the photographer until fully paid by the client(s).

4. FORCE MAJEURE

i. In the rare event of cancellation or total photographic failure, the photographer's liability is limited to a full refund of fees paid. ii. In case of unavoidable circumstances preventing the photographer's attendance, efforts will be made to connect the client(s) with an alternative photographer.

5. DIGITAL FILES

i. All digital files are the property of the photographer and provided to the client for non-commercial use. ii. The photographer's liability for lost, damaged, or destroyed digital files is limited to a full refund of deposits and fees, excluding goods already received.

6. ON THE DAY

i. Clients must arrive before the agreed-upon time for the photoshoot. ii. If the client is more than 30 minutes late, the photographer may cancel the session, and the session fee is due from the client.

7. CANCELLATION FEES

i. Clients can cancel up to 24 hours before the shoot, with no refund afterward. Deposits are only refundable in case of inappropriate weather conditions (heavy rain). ii. If the client is more than 30 minutes late, the photographer will cancel the session, with no refund. iii. Weather-related rescheduling is at the photographer's discretion. If no suitable alternative is available, the client can request a total refund. iv. The deposit is non-refundable but can be used to book another session.

8. DELIVERY

i. Unedited digital pictures are delivered within 48 hours via an online gallery. These images are watermarked and not downloadable. The client can then select pictures for editing. ii. The photographer aims to deliver edited digital files promptly, typically within 7 working days after picture selection, during busy periods. iii. Unedited pictures are not included in the photoshoot package.
